Based on the findings of an offsite state relicensure survey completed March 15, 2022, Optimal Homecare Solutions, Inc was found to be in compliance with the following requirement of PA Code, Title 28, Health and Safety, Part IV, Health facilities, Subpart A, Chapter 51.

Based on the findings of an offsite state relicensure survey completed March 15, 2022, Optimal Homecare Solutions, Inc was found not to be in compliance with the following requirements of PA Code, Title 28, Health and Safety, Part IV, Health Facilities, Subpart H, Chapter 611, Home Care Agencies and Home Care Registries.

611.51(a) LICENSURE
Hiring or Rostering Prerequisites

Name - Component - 00
Prior to hiring or rostering a direct care worker, the home care agency or home care registry shall: (1) Conduct a face-to-face interview with the individual. (2) Obtain not less than two satisfactory references for the individual. A satisfactory reference is a positive, verifiable reference, either verbal or written, from a former employer or other person not related to the individual that affirms the ability of the individual to provide home care services. (3) Require the individual to submit a criminal history report, in accordance with the requirements of § 611.52 (relating to criminal background checks), and a ChildLine verification, if applicable, in accordance with the requirements of § 611.53 (relating to child abuse clearance).

Observations:


Based on review of direct care worker personnel files (PF), and staff (EMP) interview, the agency failed to obtain two satisfactory references, and require the individual to submit to a criminal history report, prior to hiring the direct care worker for five (5) of five (5) personnel files reviewed (PF1-PF5).

Findings included:

Review of personnel files was conducted on March 15, 2022, from approximately 9:30 a.m. to 10 a.m.

PF1 was hired on 7/26/2021. PF1 did not contain two satisfactory references and contained a criminal history report that was submitted on 3/4/2022. (Requirements not completed prior to hire)

PF2 was hired on 12/13/2021. PF2 did not contain two satisfactory references and contained a criminal history report that was submitted on 3/4/2022. (Requirements not completed prior to hire)

PF3 was hired on 8/16/2021. PF3 did not contain two satisfactory references and contained a criminal history report that was submitted on 3/4/2022. (Requirements not completed prior to hire)

PF4 was hired on 11/21/2021. PF4 did not contain two satisfactory references and contained a criminal history report that was submitted on 3/4/2022. (Requirements not completed prior to hire)

PF5 was hired on 9/27/2021. PF5 did not contain two satisfactory references and contained a criminal history report that was submitted on 3/4/2022. (Requirements not completed prior to hire)

Findings confirmed with EMP 1 (Administrator) on 3/15/2022 at approximately 1:40 p.m. to 2:10 p.m. during exit conference.





Plan of Correction:

Prior to hiring all direct care workers, the following will be obtained:
1-Obtain two satisfactory references that verify applicants ability to do the job and document all attempts to obtain two valid references.
2-Obtain a criminal history report

The agency director will audit all new hire files to ensure compliance with all hiring prerequisites prior to scheduling.



611.52(d) LICENSURE
Proof of Residency

The home care agency or home care registry may request an individual required to submit or obtain a criminal history record to furnish proof of residency through submission of any one of the following documents:
(1) Motor vehicle records, such as a valid driver ' s license or a State-issued identification.
(2) Housing records, such as mortgage records or rent receipts.
(3) Public utility records and receipts, such as electric bills.
(4) Local tax records.
(5) A completed and signed, Federal, State or local income tax return with the applicant ' s name and address preprinted on it.
(6) Employment records, including records of unemployment compensation

Observations:


Based on review of direct care worker personnel files (PF), and staff (EMP) interview, the agency failed to verify proof of residency in Pennsylvania for 2 years prior to date of hire for four (4) of five (5) personnel files reviewed (PF1-PF3, PF5).

Findings included:

Review of personnel files was conducted on March 15, 2022, from approximately 9:30 a.m. to 10 a.m.

PF1 was hired on 7/26/2021. There was no documented evidence to verify proof of PA residency for the two years immediately preceding the date of hire.

PF2 was hired on 12/13/2021. There was no documented evidence to verify proof of PA residency for the two years immediately preceding the date of hire.

PF3 was hired on 8/16/2021. There was no documented evidence to verify proof of PA residency for the two years immediately preceding the date of hire.

PF5 was hired on 9/27/2021. There was no documented evidence to verify proof of PA residency for the two years immediately preceding the date of hire.

Findings confirmed with EMP 1 (Administrator) on 3/15/2022 at approximately 1:40 p.m. to 2:10 p.m. during exit conference.

Plan of Correction:

Prior to hiring all direct care workers, a satisfactory two year proof of residency in the state of Pennsylvania will be obtained. Satisfactory proofs include the following:

1- Motor vehicle records, such as a
valid driver's license or a State-
issued identification.
2- Housing records, such as mortgage
records or rent receipts.
3- Public utility records and receipts,
such as electric bills.
4- Local tax records.
5- A completed and signed, Federal,

611.55(c) LICENSURE
Competency Requirements

Name - Component - 00
A competency examination or training program developed by an agency or registry for a direct care worker who will provide personal care must address the following additional subject areas: 1. Bathing, shaving, grooming and dressing; 2. Hair, skin and mouth care; 3. Assistance with ambulation and transferring; 4. Meal preparation and feeding; 5. Toileting; 6. Assistance with self-administered medications.

Observations:


Based on a review of agency personnel files (PF), agency competency checklist and staff (EMP) interview, the agency failed to ensure direct care workers (DCW) met competency requirements including bathing, shaving, grooming, dressing, hair, skin, mouth care, assistance with ambulation, transferring, meal prep, feeding and toileting, prior to consumer contact for five (5) of five (5) personnel files reviewed (PF1-PF5).

Findings included:

Review of personnel files was conducted on March 15, 2022, from approximately 9:30 a.m. to 10 a.m.

Plan of Correction:

All newly hired caregivers will undergo a 4 hour training class where competency for bathing, shaving, grooming, dressing, hair skin & mouth care, assistance with ambulation, transferring, meal preparation, feeding and toileting will be evaluated. A comprehensive checklist including all required skills for Personal Care Workers will be implemented. This checklist will include evaluations of competency regarding the required skills for PCWs.

The Agency Director will ensure this is completed on hire of all new caregivers.

Additionally, the Agency Director will conduct annual reviews for the required skillset for PCWs.

All of the above will be documented and kept on file.
